FMLA, leave and job protection during IOP

The question behind most first calls is whether treatment costs someone their job. Federal and California leave law exist for exactly this, and an evening cohort means many people never need to use them. Both routes, plainly.

The short answer

Treatment by a provider can be covered leave. Use, on its own, is not.

The federal Family and Medical Leave Act gives an eligible employee up to twelve workweeks of unpaid, job-protected leave in a twelve-month period for a serious health condition (29 U.S.C. 2612). The regulations address substance use directly: leave may be taken for treatment of substance use by a health care provider, while absence because of use, rather than treatment, is not protected (29 C.F.R. 825.119).

Leave does not have to be taken in one block. Intermittent and reduced-schedule leave exist (29 C.F.R. 825.202), and that is the shape treatment hours usually take. In California, the Family Rights Act runs alongside the federal entitlement (California Government Code 12945.2), and State Disability Insurance may replace part of the wage. The Employment Development Department decides that, not an employer and not us.

The other route is not needing leave at all. Evening cohorts exist so that a full shift and a treatment day can sit in the same twenty-four hours, which is the arrangement most of our patients choose.

Your options

What each route gives you.

Federal FMLA

Up to twelve workweeks of unpaid, job-protected leave in a twelve-month period for a serious health condition (29 U.S.C. 2612).

Who is eligible

Employers with 50 or more employees within 75 miles, and an employee with twelve months of service and 1,250 hours worked in the prior year.

Substance use specifically

Leave for treatment by a health care provider may be covered. Absence because of use, rather than treatment, is not (29 C.F.R. 825.119).

Intermittent leave

Leave can be taken in blocks or on a reduced schedule (29 C.F.R. 825.202), which is how treatment hours generally fit around a job.

California CFRA

The California Family Rights Act runs alongside the federal entitlement (Government Code 12945.2) and reaches smaller employers.

Wage replacement

State Disability Insurance may pay part of the wage during leave. The Employment Development Department decides eligibility.

Short-term disability

A private policy, with its own definitions and its own carrier decision. Read the policy before you count on it.

Accommodation instead of leave

A schedule change can be requested as a reasonable accommodation, which is a separate route from taking leave.

What the employer may ask for

A certification from a health care provider about the need for leave. It is not a request for your full clinical file.

What we release

Attendance and clinical documentation, to the parties you name in writing, and nothing else. 42 CFR Part 2 protects substance use treatment records.

What we never do

Contact an employer, a union or a licensing body without your written authorization.

What this page is not

Legal advice. Your own situation is a question for an employment lawyer or your HR benefits team.

Cost and insurance

We read your plan before you commit to anything.

Covered by many PPO plans. We check your benefits first.

Shift bills most major commercial plans on an out-of-network basis, and in-network credentialing is in process. We read your plan, tell you what it pays toward intensive outpatient care, and give you that number in writing before your first appointment.

Medi-Cal. We cannot bill Medi-Cal today, because we hold no county contract yet. If Medi-Cal is your coverage, tell us and we will point you to a county provider who can help now.

More on coverage: what it costs, what out-of-network means, your carrier.

Leave questions

The ones people ask first.

Can I use FMLA for IOP?

If you are an eligible employee at a covered employer, leave for treatment of a serious health condition by a health care provider is what the statute addresses, and the regulations name substance use treatment specifically (29 C.F.R. 825.119). Whether your own leave is approved is between you, your employer and, where applicable, the Department of Labor.

Does FMLA cover mental health treatment?

The statute covers a serious health condition without separating mental and physical health. The certification is the mechanism either way.

Will my employer be told my diagnosis?

Not by us. We release only what you authorize in writing, and substance use treatment records carry additional protection under 42 CFR Part 2. A leave certification asks about the need for leave, not about your clinical detail.

Does short-term disability cover IOP?

That depends entirely on the policy language and the carrier's own decision. Read the policy, and ask the carrier before you plan around it.

Can I do this without taking leave at all?

Often, yes. Three to five hours a day in an evening cohort is what makes that possible. See how the schedule fits a full-time job.

Ask what we can document.

On the first call we tell you exactly what attendance and clinical documentation we can provide, and to whom, before anything is released.

If you or someone you are with is in immediate danger, call or text 988 (the Suicide and Crisis Lifeline) or call 911. Shift Support Network is an outpatient program and is not an emergency service. Related: Treatment while working · Privacy practices · How long IOP lasts · First responders.

Verify your benefits, same business day.

Send us the carrier on your card and we tell you what the plan actually covers before you commit. Call anytime and leave a message. We return calls the same business day.
